1. Acceptance of Terms

By accessing or using LivingScore ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of the Service immediately.

2. Description of Service

LivingScore provides residential location scoring for Swiss addresses based on publicly available data and proprietary algorithms. Scores are provided for informational purposes only and do not constitute professional advice of any kind (legal, financial, real estate, or otherwise).

3. Accuracy and Currency of Data

We strive to keep data accurate and up to date, but we make no warranties — express or implied — regarding the completeness, accuracy, timeliness, or fitness for a particular purpose of any score or data provided. Source datasets (including noise maps, pollution indices, public transport timetables, tax rates, and property price averages) are updated on varying schedules and may not reflect the most recent real-world conditions. Scores should be treated as indicative estimates only. Users must independently verify all information before making any financial, legal, or property-related decision.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

5. Subscriptions and Payments

Paid plans are billed in advance on a monthly, quarterly, or annual basis. All prices are exclusive of value-added tax (VAT), which will be added where applicable. All fees are non-refundable except as required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Payment processing. Payments are processed by Stripe. If payment fails or is not received on time, LivingScore may immediately suspend access to paid features until all outstanding amounts are settled. Repeated or prolonged non-payment may result in account termination without refund of any prepaid fees.

Electronic invoicing. Invoices and billing communications are delivered electronically to the email address registered on your account. An invoice is deemed delivered once it has been sent to your registered email address, regardless of whether you actually read it.

6. Eligibility and Geographic Access

The Service is intended for users who are at least 18 years of age. By creating an account you represent that you are 18 or older and have the legal capacity to enter into a binding agreement. If you are accessing the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

The Service is designed for use within Switzerland and the European Economic Area. Users who are subject to legislation that prohibits or restricts access to services of this type — based on their nationality, place of residence, or any other reason — are not permitted to access or use the Service. By accessing the Service you confirm that no such restrictions apply to you.

7. Free Tier

A limited free tier is available at no charge. The free tier provides access to an overall location score only, without category breakdowns, priority personalisation, or price comparison data. LivingScore reserves the right to modify, restrict, or discontinue the free tier at any time without notice or liability. Free tier usage is subject to fair-use limits; accounts showing automated or excessive usage may be throttled or suspended.

8. Prohibited Use

You may not use the Service to: (a) scrape or systematically download data; (b) resell or redistribute scores without written permission; (c) attempt to reverse-engineer any scoring algorithm; or (d) use the Service in any manner that violates applicable Swiss or EU law.

9. User Warranties

By using the Service you represent and warrant that:

• You will use the Service solely for lawful purposes and in accordance with these Terms.
• You will use your account on an exclusively personal basis and will not share your login credentials with or grant access to any third party.
• All information you provide when registering or using the Service is accurate, complete, and kept up to date.
• You will not use the Service to transmit unsolicited commercial communications or to promote your own or third-party products or services.
• You will not attempt to probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures.
• You will promptly notify LivingScore of any unauthorised access to or use of your account.
• You will notify LivingScore promptly of any technical faults, errors, or security vulnerabilities you discover on the Service at support@livingscore.ch.

LivingScore is entitled, but not obligated, to monitor usage for compliance with these warranties and may suspend or terminate access without prior notice if a breach is detected.

10. Intellectual Property

All content, scoring methodologies, algorithms, and software underlying the Service are the exclusive property of LivingScore. No licence is granted beyond the limited, non-exclusive, non-transferable right to use the Service for your own personal or internal business purposes as described herein. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology.

11. Third-Party Links and Services

The Service may contain links to or integrations with third-party websites and services (including Mapbox, Stripe, and Swiss federal data sources). LivingScore does not control and is not responsible for the content, accuracy, or availability of any third-party website or service. The inclusion of any link does not imply endorsement by LivingScore. Access to third-party services is subject to their respective terms of use and privacy policies, for which LivingScore bears no responsibility.

12. Service Availability

LivingScore provides the Service on a best-efforts basis. We do not guarantee uninterrupted, error-free, or continuous availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice or liability.

13. Termination and Suspension

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behaviour, or if required to do so by law. Upon termination, your right to access the Service ceases immediately. If you wish to close your account, you may do so at any time via your account settings or by contacting us at support@livingscore.ch. Termination does not entitle you to a refund of any prepaid fees.

14. Limitation of Liability

To the maximum extent permitted by applicable law, LivingScore shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind arising out of or related to your use of, or inability to use, the Service.

No reliance for purchase or investment decisions. Scores, rankings, and data provided by LivingScore are for informational purposes only. They do not constitute advice to buy, rent, sell, or otherwise transact in real estate or any other asset. Any property purchase, rental commitment, or financial decision made in whole or in part on the basis of information obtained through the Service is made entirely at your own risk. LivingScore expressly excludes all liability for losses — financial or otherwise — arising from such decisions.

Data currency and obsolescence. Scores are computed from datasets that may be updated periodically but are not real-time. Environmental conditions, noise levels, infrastructure, tax rates, property prices, and other parameters can change without notice. LivingScore makes no representation that any score reflects current conditions at the time you access it, and accepts no liability for decisions made on the basis of data that has since become outdated, inaccurate, or incomplete.

Cyber attacks and malicious technology. LivingScore shall not be liable for any damage caused by cyber attacks, computer viruses, malware, spyware, ransomware, or any other malicious technology targeting the Service or your device. LivingScore is not responsible for security deficiencies in third-party telecommunications networks or the internet, nor for interruptions caused by maintenance, technical faults, or the introduction of new technologies.

No liability. To the fullest extent permitted by applicable law, LivingScore accepts no liability whatsoever — whether in contract, tort, statute, or otherwise — for any loss or damage of any nature arising out of or in connection with your use of the Service or any data, score, or information obtained through it.

15. Indemnification

You agree to indemnify, defend, and hold harmless LivingScore and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or third-party rights; or (c) any content or data you submit to the Service.

16. Force Majeure

LivingScore shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government action, power failures, internet outages, or failures of third-party infrastructure providers.

17. Governing Law

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.

18. Changes to Terms

We reserve the right to update these Terms at any time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date.

19. General Provisions

Severability. If any provision of these Terms is found to be invalid or unenforceable, it shall be replaced by a legally permissible provision that most closely reflects the original intent. The remaining provisions shall continue in full force and effect.

Waiver. Failure by LivingScore to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.

No set-off. You may not offset any claims you may have against LivingScore against any amounts owed by you to LivingScore under these Terms.

Assignment. You may not assign or transfer any rights or obligations under these Terms without our prior written consent. LivingScore may assign its rights and obligations freely, including in the event of a merger, acquisition, or sale of assets.

Electronic communications. All notices and communications from LivingScore will be delivered electronically to your registered email address or posted within the Service. Such communications are deemed received once sent, regardless of whether you read them.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and LivingScore with respect to the Service and supersede all prior agreements and understandings.
